# Terms of Service

Effective date: March 10, 2025

These Terms of Service govern your use of bookleafandember.com and any services provided by Leaf & Ember ("we," "us," or "our"). By using this site or submitting an inquiry you agree to these terms.

## Services

Leaf & Ember provides a luxury mobile cigar lounge experience for private events in Polk County, FL and surrounding areas. All bookings are subject to availability and our acceptance of your inquiry.

## Booking & Payment

- Submitting an inquiry form does not constitute a confirmed booking.
- A booking is confirmed only upon execution of a written agreement and receipt of a 50% deposit.
- The remaining balance is due no later than 7 days before the event date.
- Pricing is subject to change until a written agreement is signed.

## Cancellation & Refunds

- **Cancellations 30+ days before the event** — deposit refunded less a $150 administrative fee.
- **Cancellations 15–29 days before the event** — 50% of the deposit is refunded.
- **Cancellations fewer than 15 days before the event** — deposit is non-refundable.
- In the event Leaf & Ember must cancel due to circumstances beyond our control, a full refund will be issued.

## Age Requirement

Cigar and tobacco products are strictly for guests 21 years of age or older. By booking our services you confirm that appropriate age verification will be conducted at your event and that you accept responsibility for ensuring compliance with all applicable laws.

## Venue & Client Responsibilities

- You are responsible for obtaining any permits required by your venue for outdoor smoking or open flames.
- You must ensure Leaf & Ember staff have safe, unobstructed access to the setup area.
- You are responsible for notifying guests of the tobacco nature of the experience.

## Limitation of Liability

To the fullest extent permitted by law, Leaf & Ember shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid for the specific event giving rise to the claim.

## Health Disclaimer

Tobacco and cigar use carries serious health risks including cancer, heart disease, and other conditions. Our services are intended solely for adults who choose to use tobacco products at their own risk. We make no representations about the safety of tobacco use.

## Intellectual Property

All content on this site — including text, images, and branding — is the property of Leaf & Ember and may not be reproduced without written permission.

## Governing Law

These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Polk County, Florida.

## Changes to These Terms

We reserve the right to update these terms at any time. Continued use of the site after changes constitutes acceptance of the revised terms.
